Welcome to Frux. These Terms of Service ("Terms") govern your use of fruxfruit.com (the "Site") and any purchase you make through it. By using the Site, you agree to these Terms. If you don't agree, please don't use the Site.
1. About us
Frux is a Canadian brand operated by KB Trading Inc. ("Frux," "we," "us," "our"). We sell freeze-dried chocolate strawberries, date bites, fruit strips, and fruit bears, along with bundles of those products.

2. Eligibility
You must be at least 18 years old, or the age of majority in your province or territory, to make a purchase on this Site. By placing an order, you confirm you meet this requirement.
3. Account registration
You can shop on Frux as a guest or by creating an account. If you create an account, you're responsible for:
- Keeping your password secure
- All activity that happens under your account
- Notifying us at info@fruxfruit.com if you suspect unauthorized access
We may suspend or terminate accounts that violate these Terms.
4. Products and pricing
We do our best to display every product accurately, including ingredients, images, and pricing. Despite our efforts, we can't guarantee that everything on the Site is error-free.
- Colours and packaging may vary slightly from photos due to screen settings, batch variation, and packaging updates.
- Prices are listed in Canadian dollars (CAD) and may change at any time without notice.
- Pricing errors: If we discover a pricing error on a product you've ordered, we'll contact you to confirm the corrected price, cancel the order with a full refund, or honour the listed price at our discretion.
- Availability: All products are subject to availability. We reserve the right to limit quantities, discontinue products, or refuse any order at our discretion.
5. Orders and payment
When you place an order, you're making an offer to purchase. We accept your offer when we ship the order. Until then, we may decline or cancel any order for any reason — including pricing errors, suspected fraud, or stock issues — and we'll refund any payment received in full.
We accept payment methods listed at checkout, processed securely through Shopify Payments and other payment providers. By providing payment information, you confirm you're authorized to use the method and that the information is accurate.
6. Shipping and delivery
Shipping rates, processing times, and delivery estimates are described in our Shipping Policy. Once a package leaves our warehouse, delivery is handled by third-party carriers, and we can't guarantee specific arrival times.
7. Refunds and returns
Our position on returns, refunds, damaged orders, and lost packages is set out in our Refund Policy. Please review it before placing an order.
8. Food safety and allergens
Frux products are food. Please read every product page carefully before buying:
- Ingredients and allergen disclosures are listed on each product page.
- Our products are made in facilities that handle various allergens including milk, soy, peanuts, tree nuts, and sesame. Cross-contamination is possible.
- If you have a food allergy, intolerance, or dietary restriction, review the ingredient list every time — formulations can change.
- We are not a substitute for medical advice. If you have a severe allergy, consult your doctor before consuming any Frux product.
You're responsible for confirming a product is appropriate for you and anyone you serve it to.
9. Health claims
Statements made about Frux products on this Site (such as "no added sugar," "high in fibre," "95% real fruit") refer only to the specific product as labelled and are not intended to diagnose, treat, cure, or prevent any disease. Frux products are food, not medicine.
10. Newsletter and marketing
If you sign up for our newsletter, you consent to receive promotional emails from Frux. You can unsubscribe at any time via the link in any marketing email. We handle your information according to our Privacy Policy.
11. Intellectual property
Everything on this Site — including our logo, product names, photography, illustrations, recipes, copy, packaging design, and the Frux brand itself — is the property of Frux or used with permission. You may not copy, reproduce, distribute, modify, or use any of it for commercial purposes without our written consent.
You're welcome to share Frux content on social media for personal, non-commercial use, as long as you don't alter or misrepresent it.
12. User content
If you submit a review, comment, photo, or other content to the Site or to our social channels (tagging us or using our hashtags), you grant Frux a worldwide, royalty-free, perpetual licence to use, reproduce, and share that content for marketing and brand purposes. You confirm that the content is yours to share and doesn't infringe on anyone else's rights.
We may remove user content at our discretion, especially anything that's offensive, misleading, or violates these Terms.
13. Acceptable use
When using this Site, you agree not to:
- Use it for any unlawful purpose
- Attempt to gain unauthorized access to our systems
- Interfere with the Site's operation or security
- Use bots, scrapers, or automated tools to collect information from the Site
- Resell our products without written authorization (see "Wholesale" below)
14. Wholesale and resale
If you'd like to carry Frux at your store or business, we have a wholesale program — contact info@fruxfruit.com for our line sheet and terms. Buying retail quantities for resale is not permitted without a wholesale agreement.
15. Disclaimers
We provide this Site and our products "as is" and "as available." To the fullest extent permitted by law:
- We don't warrant that the Site will be uninterrupted, error-free, or secure.
- We don't warrant that any product will meet your specific dietary or health goals.
- All implied warranties — including merchantability, fitness for a particular purpose, and non-infringement — are disclaimed except where prohibited by law.
Nothing in these Terms limits any rights you have under the consumer protection laws of your province or territory that cannot be waived by agreement.
16. Limitation of liability
To the fullest extent permitted by law, Frux, its officers, employees, and suppliers will not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the Site or our products. Our total liability for any claim related to your order is limited to the amount you paid for that order.
This limitation doesn't apply to liability that cannot be limited under applicable law (for example, liability for gross negligence or wilful misconduct).
17. Indemnification
You agree to defend and indemnify Frux against any claims, damages, or expenses arising from your misuse of the Site, your violation of these Terms, or your violation of any third-party rights.
18. Third-party links
The Site may link to third-party websites (social media, retailer locators, news articles). We don't control these sites and aren't responsible for their content, privacy practices, or terms.
19. Changes to these Terms
We may update these Terms at any time. The current version is always posted at fruxfruit.com/policies/terms-of-service, with an "Effective" date at the top. Continuing to use the Site after changes are posted means you accept the updated Terms.
20. Governing law
These Terms are governed by the laws of the Province of Ontario, Canada, and the federal laws of Canada that apply within Ontario, without regard to conflict-of-law principles. Any dispute will be resolved in the courts of Ontario, unless applicable consumer protection laws require otherwise.
21. Severability
If any part of these Terms is found to be invalid or unenforceable, the rest of the Terms remain in full effect.
